Notification of order following investigation of oil spill on Draugen

The Petroleum Safety Authority Norway (PSA) has conducted an investigation of the incident that occurred on Draugen on 10 January 2008, which led to an oil spill of about 6 m3 to the sea. On the basis of our findings we have issued an order to A/S Norske Shell (Shell) and Teekay Shipping Norway AS (Teekay).


In connection with loading of oil from Draugen to the tanker Navion Scandia on 10 January 2008, an undesired incident occurred which resulted in the loading hose being ruptured. This led to an acute oil spill of about 6 m3 to the sea.

The operator of Draugen is A/S Norske Shell and the tanker is owned and operated by the shipping company Teekay Shipping Norway AS.

Shell’s emergency response organisation handled the situation in line with their established routines. The same applies to the shipping company and their notification and contingency handling in the initial phase of the incident.

The incident did not lead to any direct danger to personnel on board the Navion Scandia or Draugen.

Our investigation identified seven deviations from the regulatory requirements. Two of these are related to Shell’s deficient compliance with the operator’s supervisory duty and deficient management and overview of contractual matters.

As regards Teekay we identified some deviations within maintenance management, competence management, follow-up of incidents involving buoy loading and the use of safety-critical information, management of changes and management follow-up.

We have issued a notification of order to Shell as follows:
Pursuant to Section 3 of the Management Regulations relating to health, environment and safety, and Section 5 of the Framework Regulations relating to responsibility in accordance with the first and second paragraphs of these regulations, cf. Section 58 of the Framework Regulations relating to individual decisions, A/S Norske Shell is ordered to identify and implement necessary improvements in the company’s management of loading operations.

Shell must also consider whether there are other relevant matters than those described in the appended report which should form the basis for this improvement work.

The deadline for implementing the order is 1 July 2008. We are to be notified when the order is considered to have been complied with.

Teekay received the following notification of order based on the investigation of the oil spills on both Draugen and Statfjord:
Pursuant to Section 3 of the Management Regulations relating to health, environment and safety, and Section 5 of the Framework Regulations relating to responsibility in accordance with the first paragraph of these regulations, cf. Section 58 of the Framework Regulations relating to individual decisions, Teekay Shipping Norway a.s. is ordered to identify and implement necessary improvements in the company’s planning and implementation of loading operations, particularly as regards the management system for maintenance and inspection of the bow loading system (BLS).

The deadline for implementing the order is 1 July 2008. We are to be notified when the order is considered to have been complied with.

We have requested that any comments on both notifications of order be submitted by 20 April 2008.
