Orders issued following fatality on Oseberg B

Orders have been issued to StatoilHydro, Aibel and the StS Group in accordance with previous notification following the fatal accident on Oseberg B on 7 May 2009.


Order vs. notification of order:

An order is a administrative decision made pursuant to the regulations. Before we issue an order, we usually submit a "notification of order" to the companies involved.

A notification of order is neither a measure nor a warning of sanctions, but part of our administrative process in accordance with the established rules of procedure. The notification is just a first step before an administrative decision is made.

An order is a forceful preventive measure which is legally binding on the recipient.
 

During the dismantling of scaffolding on Oseberg B on 7 May 2009, a scaffolder was seriously injured when he fell 14 metres from the scaffolding and down to the cellar deck. He brought to Haukeland University Hospital in Bergen by an SAR helicopter, and later died in the hospital.

In our investigation of the incident, we identified non-conformities in relation to the regulatory requirements regarding insufficient risk assessment, insufficient planning, insufficient competence, insufficient clarification of management and roles, deficient governing documentation and deficient compliance with the supervisory duty.

Based on our findings, we issued a notification of order to StatoilHydro, Aibel AS and the StS Group AS.

In accordance with the notification, the following order has been issued to StatoilHydro:
Pursuant to Section 58 of the Framework Regulations relating to administrative decisions, cf. Section 3 of the Management Regulations relating to management of health, environment and safety and Section 5 of the Framework Regulations relating to responsibility, second subsection, and Section 14 relating to qualification and follow-up of other participants, StatoilHydro is ordered to ensure that working conditions for scaffolders are safe when assembling and/or dismantling
scaffolding at facilities operated by StatoilHydro.

The deadline for complying with the order is set at 1 February 2010. The PSA must be notified when the order has been complied with.

In accordance with the notification the following order has been issued to Aibel:
Pursuant to Section 58 of the Framework Regulations relating to administrative decisions, cf. Section 3 of the Management Regulations relating to management of health, environment and safety, Section 5 of the Framework Regulations relating to responsibility, first subsection, and Section 14 relating to qualification and follow-up of other participants, Aibel is ordered AS to ensure safe working conditions for scaffolders when assembling and/or dismantling scaffolding during assignments in the petroleum industry.

This includes, but is not limited to:

The deadline for complying with the order is set at 1 February 2010. We must be notified when the order has been complied with.

In accordance with the notification, the following order has been issued to the StS Group:
Pursuant to Section 58 of the Framework Regulations relating to administrative decisions, cf. Section 3 of the Management Regulations relating to management of health, environment and safety and Section 5 of the Framework Regulations relating to responsibility, first subsection, the StS Group AS is ordered to ensure safe working conditions for scaffolders when assembling and/or dismantling scaffolding during assignments in the petroleum industry.
